These Terms & Conditions (the “Terms”) govern your access to and use of the Custrox platform, websites, mobile and web applications, and related services (collectively, the “Service”) operated by Custrox (“Custrox”, “we”, “us” or “our”). By creating an account or using the Service you (“you”, the “Customer” or “User”) agree to be bound by these Terms.
These Terms and any dispute or claim arising out of or in connection with them are governed by and construed in accordance with the federal laws of the United Arab Emirates (the “UAE”) and, where applicable, the laws of the Emirate of Dubai. The courts of Dubai, UAE shall have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you may have under UAE law.
You must be at least 18 years old and legally able to enter into a binding contract under UAE law. You are responsible for the accuracy of the information you provide, for safeguarding your account credentials, and for all activity that occurs under your account. You must notify us promptly of any unauthorised use.
Custrox provides a customer-relationship and AI-assistance platform for real-estate businesses, including automated messaging, AI voice calling, lead management and scheduling. Certain features rely on artificial intelligence and third-party providers; outputs may contain inaccuracies and must not be relied upon as professional, legal or financial advice. You are responsible for reviewing AI-generated communications before they are relied upon.
The Service may only be used to contact people you are lawfully entitled to contact.
Custrox is not designed, intended or licensed for spam or unsolicited marketing. Inbound leads, existing clients and anyone who has opted in may be called or messaged. Outbound calling — including the AI-assisted Sourcing feature, which places calls to property owners on your behalf — may only be used where the recipient has given documented, prior consent to be contacted by your agency (for example a listing enquiry, a signed form, an opt-in on your website or a recorded verbal agreement) and where the contact complies with the rules of the UAE Telecommunications and Digital Government Regulatory Authority (TDRA), the Dubai Land Department and RERA. Every Sourcing call must be attributed to the agency, must identify the caller, and must honour any request to stop.
You are solely and fully responsible for obtaining, recording and being able to produce proof of that consent. Custrox accepts no responsibility or liability whatsoever if the Service is used for unsolicited marketing, spam, or any call or message made without the recipient’s consent. Such use is a breach of these Terms, is undertaken entirely at your own risk and on your own legal responsibility, and may result in immediate suspension or termination of your account.
You agree not to use the Service to:
You are solely responsible for ensuring that your outbound calls and messages (including AI-generated calls and WhatsApp/SMS messages) comply with applicable UAE laws and the terms of the relevant messaging or telephony providers, and that recipients have given any consent required for such contact.
We process personal data in accordance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the “PDPL”). Where you upload or process the personal data of your own customers and leads through the Service, you act as the data controller and Custrox acts as a data processor on your behalf and on your documented instructions. You warrant that you have a lawful basis and any necessary consents to collect, upload and process such data, and to instruct us to contact those individuals.
We apply appropriate technical and organisational measures to protect personal data and will assist you, so far as reasonably practicable, in meeting your obligations under the PDPL, including in responding to data-subject requests and personal-data breaches.
You agree that electronic records, acceptances and signatures used through the Service are valid and enforceable in accordance with UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services.
Access to paid plans is subject to the fees and usage allowances (including AI call minutes, AI messages and user seats) set out in your selected package, which may be configured for your account by Custrox. Fees are quoted exclusive of UAE Value Added Tax (VAT), which will be added where applicable at the prevailing rate. Usage allowances are enforced and may be suspended or limited when an allowance is reached. Unless stated otherwise, fees are non-refundable except where required by UAE consumer-protection law.
Nothing in these Terms excludes or limits any rights you may have as a consumer under UAE Federal Law No. 15 of 2020 on Consumer Protection and its implementing regulations.
The Service, including its software, design and content (excluding your data), is owned by Custrox and its licensors and is protected by UAE Federal Decree-Law No. 38 of 2021 on Copyrights and Neighbouring Rights and other applicable laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service during your subscription. You retain ownership of the data you upload.
The Service integrates third-party providers (including AI, telephony and messaging providers). Your use of those features may be subject to the providers’ own terms, and we are not responsible for their acts, omissions or availability.
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by UAE law, we exclude all implied warranties and shall not be liable for indirect, incidental or consequential loss, loss of profit, data or goodwill. Our total aggregate liability arising out of or in connection with the Service shall not exceed the fees paid by you to Custrox in the three (3) months preceding the event giving rise to the claim. Nothing limits liability that cannot be excluded under UAE law.
We may suspend or terminate your access if you breach these Terms, exceed your usage allowance, or where required by law. You may stop using the Service at any time. On termination, your right to use the Service ceases; we will handle your data in accordance with the PDPL and our retention practices.
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
